Monash Unicomm Retail Services Staff
This Part shall apply to all trades and services staff engaged in catering and/or retail services (including Tea Attendants) but does not extend to Sports Control Desk staff employed within the Sports and Recreation Centre on Clayton Campus.
101. SEASONAL EMPLOYMENT FOR STAFF OTHER THAN MONASH UNICOMM CATERING STAFF AND MONASH UNICOMM RETAIL SERVICES STAFF
101.1 The University may engage staff in seasonal employment where the demand for catering and/or retail services is subject to seasonal fluctuation.
101.2 Each seasonal employment engagement of a staff member shall be no less than the period of a single semester but less than a calendar year.
101.3 Staff may be engaged in seasonal employment to work either 38 hours per week or a fraction of 38 hours per week.
101.4 The period between the completion of one seasonal employment engagement and the commencement of the staff member's next seasonal employment engagement will not interrupt the staff member's continuity of service with the University where such period is twelve months or less. Provided that such intervening period will not count as service for the accrual of leave or for the purposes of incremental progression, eligibility for parental leave, the accrual of non-cumulative University holidays for the annual Christmas/New Year closedown, and/or the calculation of service for severance payments.
101.5 Probation periods do not apply where the staff member's second or subsequent seasonal employment engagement is in the same position as the staff member's initial seasonal employment engagement.
102. LEAVE AND HOLIDAY ENTITLEMENTS FOR SEASONAL STAFF OTHER THAN SEASONAL MONASH UNICOMM CATERING STAFF AND SEASONAL MONASH UNICOMM RETAIL SERVICES STAFF
The voluntary reduced working year scheme under clause 60 of this Agreement is not available to seasonal staff. Otherwise, seasonal staff shall enjoy the same leave and holiday entitlements as full-time and part-time staff subject to the following conditions.
102.1 Annual leave
Annual leave shall accumulate at the rate of one-twelfth of ordinary time worked.
Except where the staff member has already accepted an offer from the University for a subsequent seasonal employment engagement and the intervening period is no more than twelve months, seasonal staff will receive payment in lieu of annual leave accrued upon the expiry of each seasonal employment engagement or the termination of their employment by death, dismissal, notice, resignation, or retirement where such termination precedes the seasonal employment engagement expiry.
102.2 Christmas/New Year closedown arrangements
Where a seasonal staff member leaves the employ of the University prior to the commencement of the closedown period or his/her seasonal employment engagement expires prior to the commencement of the closedown period, he/she will receive payment in lieu of working Labour Day, Queen's Birthday, and/or Melbourne Cup Day at the rate of one day's pay for each of those days worked.
102.3 Long service leave
Except where the staff member has already accepted an offer from the University for a subsequent seasonal employment engagement and the intervening period is no more than twelve months, seasonal staff will receive payment in lieu of any accrued long service leave entitlement upon the expiry of each seasonal employment engagement or the termination of their employment by death, dismissal, notice, resignation, or retirement where such termination precedes the seasonal employment engagement expiry.
102.4 Parental leave
For the purposes of adoption leave and maternity leave, each seasonal employment engagement shall be regarded as employment on a short-term contract.
102.5 Sick leave
Sick leave shall accumulate at the rate of one-sixteenth of ordinary time worked.
Sick leave entitlements are cumulative from year to year provided that any break between a staff member's seasonal employment engagements is no more than twelve months. |
