Part 5 - Conditions applying to miscellaneous services staff

Section 4 - Hours of Work, Breaks, Overtime, Shift Work, Weekend Work

This Part shall apply to the following categories of trades and services staff:

  • Child Care Workers, including Kindergarten and Play Centre Assistants
  • Drivers
  • Kindergarten Teachers
  • Mothercraft Nurses
  • Control Room Operators of the Security and Traffic Section on Clayton Campus
  • Security patrol staff on Peninsula Campus
  • Sports Control Desk staff on Clayton Campus
  • Staff engaged in printing or related graphic arts services
  • Storage services staff

126. HOURS OF WORK FOR CONTROL ROOM OPERATORS AND SECURITY PATROL STAFF (EXCLUDING CASUAL STAFF)

D The standard ordinary hours of work shall be an average of 38 per week to be worked on one of the following bases:

  • 38 hours within a work cycle not exceeding seven consecutive days; or
  • 76 hours within a work cycle not exceeding fourteen consecutive days; or
  • 114 hours within a work cycle not exceeding twenty-one consecutive days; or
  • 152 hours within a work cycle not exceeding twenty-eight consecutive days.

Provided that where the objective is for staff members to have more than one Rostered Day Off (RDO) in a four-week cycle by mutual agreement between the university and the majority of Control Room Operators and security patrol staff on campus, the university and those staff may agree that the ordinary hours exceed more than the standard hours fixed for a day's work, but not exceeding 12 hours on any day, thus enabling a week day off to be taken more frequently than would otherwise apply.

126.2 Every staff member shall be entitled to work his/her standard hours of work in one of the following ways subject to agreement between the university and the majority of Control Room Operators and security patrol staff on campus:

  • By working a 19-day four-week cycle of eight hours per day with 0.4 of one hour for each day worked accruing as an entitlement to take an RDO between Monday to Friday in each four-week cycle with either one week day fixed on which all staff members will be off during a particular work cycle or the University rostering staff off on various days of the week during a particular work cycle so that each staff member has one day off during that cycle; or
  • By working shorter hours each day; or
  • By working shorter hours on one or more days each week.

Provided that a maximum of ten RDOs may be banked by agreement between the university and the staff member concerned.

126.3 Where an RDO coincides with a Saturday or Sunday the RDO shall by mutual agreement between the University and the staff concerned be either taken in advance or taken on the normal rostered working day following such Saturday or Sunday.

126.4 Each day of paid leave taken and any holiday observed by the University and occurring during the relevant RDO accrual period of four weeks or less shall be regarded as a day worked for RDO accrual purposes provided that each day of paid leave is debited by the same number of hours that the staff member would otherwise have been required to work for RDO accrual purposes on that day had he/she not been on leave.

126.5 The University shall notify the hours at which staff members are required to commence or cease work. Once a work cycle is underway, it shall not be varied until that cycle has been completed.

127. HOURS OF WORK FOR MISCELLANEOUS SERVICES STAFF OTHER THAN CONTROL ROOM OPERATORS AND SECURITY PATROL STAFF

127.1 The ordinary hours of duty of staff members shall be determined by the University in accordance with this clause.

127.2 The ordinary hours of duty shall not exceed an average of 38 per week to be worked on one of the following bases:

  • 38 hours within a work cycle not exceeding 7 consecutive days;
  • 76 hours within a work cycle not exceeding 14 consecutive days;
  • 114 hours within a work cycle not exceeding 21 consecutive days;
  • 152 hours within a work cycle not exceeding 28 consecutive days.

127.3 The ordinary hours of duty for staff members other than shift staff members shall be worked

  • on any or all of the days of the week, Monday to Friday; and
  • continuously, except for meal breaks, between 6.00 am and 6.00 pm.

127.4 The ordinary hours of duty for shift staff members

  • shall be worked continuously each shift except for meal breaks;
  • shall not exceed 10 hours inclusive of meal breaks in any single shift;
  • shall be worked in accordance with clause 130.

127.5 Where the staff member's hours of duty are worked such that time is accrued towards a Rostered Day Off (RDO), each day of paid leave taken and any holiday observed by the University and occurring during the relevant RDO accrual period of four weeks or less shall be regarded as a day worked for RDO accrual purposes provided that each day of paid leave is debited by the same number of hours that the staff member would otherwise have been required to work for RDO accrual purposes on that day had he/she not been on leave.

127.6 The relevant union, having reached agreement with its local branch, and the University, may agree in writing on schemes of shift arrangements which may not attract shift allowance, provided that under these arrangements, no staff member will be mandatorily required to work a shift which extends beyond 6.00 pm, Monday to Friday without payment of shift penalty.

127.7 Notwithstanding any other provisions of this Agreement, the University may during the period Monday to Friday, and by agreement with staff member(s) concerned, establish an arrangement for extended shifts of up to nine hours thirty minutes (exclusive of meal breaks) which would not attract shift penalty. Provided that a staff member so agreeing would not be required to work on more than 80% of the ordinary working days (Monday to Friday). No formal offer of, or agreement to, such an arrangement shall be made to a staff member except in accordance with clause 9.

128. SPAN OF HOURS

With the exception of any staff engaged in shift work, the span of hours will be 6.00am to 6.00pm unless otherwise provided in this Agreement.

The scheduling of hours of work in each department/workplace shall take into consideration the provision of service to students and staff and the area's work needs. After considering those factors, a supervisor may change the start and finish times of staff within the local work area, after consultation with the affected staff member(s).

129. OVERTIME AND SHIFT WORK RATES FOR CONTROL ROOM OPERATORS AND SECURITY PATROL STAFF

129.1 Definitions

For the purposes of this clause:

  • "Afternoon shift" means any shift finishing after 6.30pm and at or before midnight
  • "Early morning shift" means any shift commencing before 6.30a
  • "Night shift" means any shift finishing after midnight and at or before 8.00am
  • "Permanent night shift" is a night shift which does not rotate or alternate with another shift or with day work so as to give the staff member at least one-third of working time off night shift in each shift cycle.

129.2 Monday to Friday

For any shift or period of work Monday to Friday, a staff member shall be paid as follows:

  • Ordinary rate of pay for the first 7.6 hours;
  • Time and a half for time worked after the first 7.6 hours and up to 9.6 hours; and
  • Double time for each hour worked beyond the first 9.6 hours.

Provided that in circumstances where a shift or period of work commences on one day and continues into the next succeeding day, overtime penalties applicable to Monday to Friday work shall apply upon the completion of the first 8 hours.

129.3 Commencing on a Friday and finishing on a Saturday

For any shift or period of work commencing on a Friday and finishing on a Saturday, a staff member shall be paid as follows:

  • The rates prescribed under clause 129.2 above for that portion of the shift or period of work performed on the Friday;
  • The rates prescribed under clause 129.4 below for that portion of the shift or period of work performed on the Saturday provided that upon the completion of the first 7.6 hours of the shift or period of work occurring at or after midnight Friday, double time shall apply for the first two hours and double time and a half thereafter.

129.4 Saturday

For any shift or period of work on a Saturday, a staff member shall be paid as follows:

  • Time and a half for the first 7.6 hours;
  • Double time for time worked after the first 7.6 hours and up to 9.6 hours; and
  • Double time and a half for each hour worked beyond the first 9.6 hours.

129.5 Commencing on a Saturday and finishing on a Sunday

For any shift or period of work commencing on a Saturday and finishing on a Sunday, a staff member shall be paid as follows:

  • The rates prescribed under clause 129.4 above for that portion of the shift or period of work performed on the Saturday;
  • The rates prescribed under clause 129.6 below for that portion of the shift or period of work performed on the Sunday provided that upon the completion of the first ten hours of the shift or period of work occurring at or after midnight Saturday, the rate of double time and a half shall apply or triple time where ten continuous hours of work have been performed on the Sunday.

129.6 Sunday

For any shift or period of work on a Sunday, a staff member shall be paid as follows:

  • Double time for the first ten hours; and
  • Triple time for each hour worked after the first ten hours.

129.7 Commencing on a Sunday and finishing on a Monday

For any shift or period of work commencing on a Sunday and finishing on a Monday, a staff member shall be paid the rates prescribed under clause 129.6 above provided that upon the completion of the first 7.6 hours of the shift or period of work at or after midnight Sunday, time and a half shall apply for the first two hours and double time thereafter.

129.8 Work in excess of 38 ordinary hours

In addition to the rates prescribed in clauses 129.2-129.7 above, a staff member shall be entitled to one half of the ordinary rate of pay for the first two hours and then the ordinary rate of pay thereafter for all time worked in excess of 38 hours per week, which shall be calculated by reference only to the total time worked during the first 7.6 hours of each shift or period of work, including any holiday observed by the university.

129.9 Shift allowance

A staff member (other than a casual staff member) shall be paid in addition to the rates prescribed in this clause as follows:
From midnight Sunday to midnight Friday inclusive but excluding work performed on a holiday observed by the University -

  1. for any "Afternoon shift", "Night shift" or "Early morning shift" as defined above - an amount being 20 per cent of the ordinary hourly rate of pay of the staff member for each ordinary hour worked;
  2. for any "Permanent night shift" as defined above - an amount being 30 per cent of the ordinary hourly rate of pay of the staff member for each ordinary hour worked.

130. SHIFT WORK FOR MISCELLANEOUS SERVICES STAFF OTHER THAN CONTROL ROOM OPERATORS AND SECURITY PATROL STAFF

130.1 Subject to any contrary provision elsewhere in this Agreement, the provisions of this clause will apply to all trades and services staff bound by this Part other than Control Room Operators and Security Staff and excluding any staff member whose salary exceeds the prescribed salary range for HEW level 7.

130.2 For the purposes of this clause:

  • "Day Shift" means any shift starting at or after 6.00am and finishing at or before 6.00pm.
  • "Afternoon Shift" means any shift finishing after 6.00pm and at or before midnight.
  • "Night Shift" means any shift finishing after midnight and at or before 8.00am.
  • "Ordinary Shift" means any shift on which a shift worker is rostered for duty within the ordinary working hours of the employee and according to the relevant roster cycle.
  • "Overtime Shift" means any shift worked by a shift worker in excess of five shifts per week.
  • "Relevant Roster Cycle" means a sequence of shifts in a roster to be normally worked by a staff member in the ordinary working hours of the staff member and arranged so as to form a recurring cycle of 5 days on shift and 2 days off per week.
  • "Rostered Shift" shall have the same meaning as "Shift".
  • "Shift" means a continuous period of work during which a shift worker is rostered for duty.
  • "Week" means a period of 7 consecutive days, calculated from the commencement of the relevant roster cycle.

130.3 Except as provided in clause 130.4, a staff member engaged on an afternoon or night shift shall for any ordinary hours on Monday to Friday inclusive be paid ordinary rate plus 15%.

130.4 A staff member (other than a casual staff member) required to work an ordinary shift on a Saturday or a Sunday shall be paid ordinary rate plus:

  • on a Saturday - 50%; and
  • on a Sunday - 100%.

130.5 A staff member whose rostered day off falls on a holiday shall be granted one day's leave in lieu of such holiday.

130.6 A staff member who without 72 hours notice is:

  • transferred from day work to shift work;
  • transferred from one shift roster to another shift roster;
  • transferred to an unrostered shift; or
  • transferred to another shift within the roster

shall be paid an additional allowance of 50% of the ordinary rate of pay of the employee for any day, afternoon or night shift to which the staff member is so transferred and which occurs before the expiry of 72 hours notice of the transfer provided that the allowance shall be payable only to a staff member in receipt of an allowance under clause 130.3. In such case the 50% allowance provided under this clause shall be payable in lieu of the allowance provided under clause 130.3.

130.7 Unless mutually agreed between a staff member and the University, shift rosters shall be arranged so as to provide for shifts to be rotated on a weekly basis.

131. WEEKEND WORK FOR MISCELLANEOUS SERVICES STAFF OTHER THAN CONTROL ROOM OPERATORS AND SECURITY PATROL STAFF

The following rates will apply for ordinary hours worked on weekends:

  • Saturday - time and a half
  • Sunday - double time
