Part 5 - Conditions applying to miscellaneous services staff

Section 5 - Leave of Absence and Holidays

  1. Temporary Closedown and Annual Leave for Miscellaneous Services Staff other than Drivers, Kindergarten and Play
    Centre Assistants, and Kindergarten Teachers
  2. Leave and Holiday Entitlements for Seasonal Child Care Workers, Kindergarten Teachers, Mothercraft Nurses, and
    Sports Control Desk Staff

This Part shall apply to the following categories of trades and services staff:

  • Child Care Workers, including Kindergarten and Play Centre Assistants
  • Drivers
  • Kindergarten Teachers
  • Mothercraft Nurses
  • Control Room Operators of the Security and Traffic Section on Clayton Campus
  • Security patrol staff on Peninsula Campus
  • Sports Control Desk staff on Clayton Campus
  • Staff engaged in printing or related graphic arts services
  • Storage services staff

132. TEMPORARY CLOSEDOWN AND ANNUAL LEAVE FOR MISCELLANEOUS SERVICES STAFF OTHER THAN DRIVERS, KINDERGARTEN AND PLAY CENTRE ASSISTANTS, AND KINDERGARTEN TEACHERS

Where the University intends temporarily to close (or reduce to nucleus) a section for the purposes (inter alia) of allowing annual leave to the staff members concerned or a majority of them, the University may give in writing to such staff members one month's notice (or, in the case of any staff member engaged after giving of such notice, notice on the date of the staff member's engagement) of intention to apply the provisions of this clause and thereupon:

  • Any staff member who at the date of closing is entitled to annual leave shall be given such annual leave commencing as on and from the date of closing and, in addition, shall be paid one-twelfth of the ordinary rate of pay for any period of employment after accrual of the staff member's right to annual leave and up to but excluding the date of closing;
  • Any such staff member who at the date of closing is not entitled to annual leave shall be given leave without pay as on and from the date of closing and shall be paid one-twelfth of the ordinary rate of pay for the period since the commencement thereof or the accrual of the staff member's last annual leave (whichever is the later) and up to but excluding the date of closing, together with pay for any holiday occurring during such leave for which the employee is entitled to payment under this Agreement; and
  • The next twelve-monthly qualifying period of employment for every such staff member shall commence on and from the date of closing.

For the purposes of this clause, "date of closing" in relation to each staff member means the first day of the staff member's annual leave pursuant to this clause.

133. LEAVE AND HOLIDAY ENTITLEMENTS FOR SEASONAL CHILD CARE WORKERS, KINDERGARTEN TEACHERS, MOTHERCRAFT NURSES, AND SPORTS CONTROL DESK STAFF

The voluntary reduced working year scheme under clause 60 of this Agreement is not available to seasonal staff. Otherwise, seasonal staff shall enjoy the same leave and holiday entitlements as full-time and part-time staff subject to the following conditions.

133.1 Annual leave

Annual leave shall accumulate at the rate of one-twelfth of ordinary time worked.

Except where the staff member has already accepted an offer from the University for a subsequent seasonal employment engagement and the intervening period is no more than twelve months, seasonal staff will receive payment in lieu of annual leave accrued upon the expiry of each seasonal employment engagement or the termination of their employment by death, dismissal, notice, resignation, or retirement where such termination precedes the seasonal employment engagement expiry.

133.2 Christmas/New Year closedown arrangements

Where a seasonal staff member leaves the employ of the University prior to the commencement of the closedown period or his/her seasonal employment engagement expires prior to the commencement of the closedown period, he/she will receive payment in lieu of working Labour Day, Queen's Birthday, and/or Melbourne Cup Day at the rate of one day's pay for each of those days worked.

133.3 Long service leave

Except where the staff member has already accepted an offer from the University for a subsequent seasonal employment engagement and the intervening period is no more than twelve months, seasonal staff will receive payment in lieu of any accrued long service leave entitlement upon the expiry of each seasonal employment engagement or the termination of their employment by death, dismissal, notice, resignation, or retirement where such termination precedes the seasonal employment engagement expiry.

133.4 Parental leave

For the purposes of adoption leave and maternity leave, each seasonal employment engagement shall be regarded as employment on a short-term contract.

133.5 Sick leave

Sick leave shall accumulate at the rate of one-sixteenth of ordinary time worked.

Sick leave entitlements are cumulative from year to year provided that any break between a staff member's seasonal employment engagements is no more than twelve months.
