Exclusion Procedures and Advisory Committee

Meeting 2/08 of the Exclusion Procedures Advisory Committee (EPAC) will be held on Friday 12th December 2008, 1-2pm in the James McNeil Room, First Floor, Building 3A, Clayton Campus.
Members having a personal interest in any item before this meeting must declare that interest to the Chair via the Committee Secretary prior to consideration of the item, and must not take part in a vote on any matter concerning it.

* 1. Membership, Attendance and Apologies

* 2. Formal Items
Certain items appearing in the agenda have been marked with an asterisk. These are items that appear to need discussion by the Committee. Items that do not are unstarred.
The Chair will move that the items remaining unstarred be adopted without discussion, and the action recommended be taken or the information therein noted by the Committee as appropriate.
* 3. Minutes of Meeting 1/2008 pp1-4
The minutes of meeting 1/2008 are attached.
Recommendation:
That EPAC confirm the minutes of meeting 1/2008 to be a true and accurate record.
* 4. Matters arising from the Minutes
* 4.1 Appeals to the Dean
It has been identified that further education of the Deans regarding APC Appeals be provided to ensure consistency and due process across faculties. Further to this, streamlining communication processes to the ESOS Reporting Team needs to be examined.
* 4.2 Express vs Registered Post
Members are invited to endorse the use of Express Post (eg yellow overnight delivery) in lieu of Registered Post. The main benefits to moving to Express Post are the ability of the post office to deliver mail to the home address even if the student is not able to sign) and the reduced costs.
4.3 Post-Appeal Process
It has been identified that there are no clear university policy and procedures for faculties to apply in relation to students when appeals are resolved after the Census Date. Key issues include the determination of which grade to be applied and should fees be remitted automatically.
Members are requested to consider the options of how to address this issue.
* 4.4 Statute and Regulations
Members are invited to discuss the recent advice that Academic Review Committees do not have the authority to set conditions prior to Notices being issued and APC Hearings being held. It is noted that ARCs only have the authority to allow students to continue or refer them to an APC Hearing.
Members are requested to discuss the status of conditions that were imposed by a ARCs last year (which are not in line with the current interpretation). The key issue is whether these conditions can still trigger an APC and therefore constitute a ground for exclusion in this years process?
Clarification is also requested on what stage a faculty board can impose conditions, regardless of whether that power has been delegated to an ARC or not.
* 4.5 Deemed Delivery Date
Feedback from members is requested on how faculties and Executive Services may apply the 20 working days appeal period.

Members are requested to note tabled document regarding feedback of the APC Training Day held 11th December 2008.
6 Future Business (for noting)
6.1 Audit of faculty rules re more than/less than 50% trigger. 6.2 Mid Year intervention review. 6.3 Membership in 2009.
