Top law students Mr Benn McGrady and Ms Tamieka Spencer took out first prize for their mooting skills in the inaugural VicHealth Legal Issues in Public Health Challenge last month. The inaugural challenge, run by the VicHealth Centre for Tobacco Control, saw the Monash team debating whether tobacco companies could be held criminally liable for the harm their products cause. The moot took the form of an appeal by a fictional tobacco company convicted of a count of conduct endangering life under Section 22 of the Crimes Act 1958 (Vic). It was argued before a distinguished bench, including Professor George Hampel, Emeritus Professor Louis Waller and Victoria's Law Reform commissioner Professor Marcia Neave. Mr McGrady and Ms Spencer (pictured), who argued against the tobacco company, were opposed by law students from the University of Melbourne. Mr McGrady also received the prize for best mooter. The Legal Issues in Public Health Challenge was established to challenge and contribute to public debate on topical legal and policy issues in public health. |
