Dismissal / Termination of Academic or Professional staff

No action should be taken to dismiss or terminate the services of a staff member without prior consultation with the Workplace Relations Branch.

Notice of termination by the University

Continuing Appointment

The University will provide to a continuing staff member written notice of termination of employment in accordance with the following table, provided that any greater period of notice specified in a staff member's employment contract will continue to apply:

Period of continuous service Period of Notice
Not more than 1 year At least 1 week
More than 1 year but not more than 3 years At least 2 weeks
More than 3 years but not more than 5 years At least 3 weeks
More than 5 years At least 4 weeks

In addition to this notice, a staff member over the age of 45 years at the time of the giving of notice and with at least two years continuous service shall be entitled to an additional week's notice, except where employed under an AWA entered into after 27 March 2006.

In the event a Head of Department, Head of Administrative Unit, or officer of similar status decides that, in the interests of the University, a terminating staff member should not be permitted to work through the whole or a part of the stipulated notice period, salary payment in lieu may be given, subject to the approval in writing by the Dean, Divisional Director or nominee as appropriate.

Nothing above shall prevent a staff member and Head of Department, Head of Administrative Unit or officer of similar status arranging to effect a mutual termination earlier than the specified notice period. Salary and entitlements will be paid to that date.

Fixed-term Appointment

The University shall provide to a fixed-term staff member written notice that at the expiry of the contract the University intends to continue the position or a position with the same or substantially similar duties or discontinue the position. Written notice will be in accordance with the following table, provided that any greater period of notice specified in a staff member's employment contract will continue to apply:

In cases of unsatisfactory performance, the University may terminate the employment of a fixed-term staff member on written notice or payment in lieu of notice in accordance with the following table:

Casual / teaching associate (sessional) staff

Casual and teaching associate (sessional) staff are engaged by the hour and the University may terminate the employment of casual / teaching associate (sessional) staff on the provision of one hour's notice.

Serious and wilful misconduct

In cases of serious and wilful misconduct for professional staff and serious misconduct for academic staff, a staff member may be dismissed without the prescribed period of notice or payment in lieu of notice applying (refer clause 53.3 - Termination of Employment and Disciplinary Action - Academic Staff and clause 54.10.1 Professional Staff Disciplinary Procedures of the Monash University Enterprise Agreement (Academic and Professional Staff) 2009 or, where applicable, the provisions of the relevant AWA Terms and Benefits Policy).

Prior consultation with the Workplace Relations Branch is required.
