Long Service Leave Procedures

Preamble

The following procedures facilitate the application of the long service leave provisions of the Monash University Enterprise Agreement (Academic and General Staff) 2005, the Monash University Enterprise Agreement (Trades and Services Staff - Building and Metal Trades Staff and Grounds and Gardening Staff) 2005, the Monash University Enterprise Agreement (Trades and Services Staff - Catering and Retail, Cleaning and Caretaking, and Miscellaneous Services Staff) 2005, and where applicable, the university's AWA Terms and Benefits Policies.

1. Taking Long Service Leave

Where the staff member takes long service leave at double his/her rate of pay, the staff member's accrued long service leave credits will reduce by twice the amount of leave actually taken.

2. Recognition of Prior Service

Prior service will not be recognised for the purposes of long service leave where there is a break in service with a recognised prior service employer of more than 12 months.

3. Long Service Leave Management - Academic and General Staff

  • Any written notice directing an academic or general staff member to reduce any long service leave balance in excess of 136.5 calendar days (19.5 weeks) will be issued by the authorised officer of the relevant Faculty or Division.
    Responsibility - All managers and supervisors
  • Written notice directing an academic or general staff member to reduce any long service leave balance in excess of 136.5 calendar days (19.5 weeks) may be revoked or varied by the authorised officer of the relevant Faculty or Division only.

  • Where a staff member is issued 6 months' written notice to reduce any long service leave balance in excess of 136.5 calendar days (19.5 weeks) and his/her leave balance is adjusted accordingly, the staff member will receive no compensation for any loss of long service leave accruals incurred.

4. Long Service Leave Management - Trades and Services Staff

4.1 Where a staff member is requested by his/her supervisor to enter into an agreement to reduce the staff member's long service leave balance to 15.6 weeks or less and the staff member does not enter into such agreement, the supervisor will refer the matter to his/her line manager.

4.2 Upon referral of the matter, the line manager may direct the staff member to reduce his/her long service leave balance to 15.6 weeks.

4.3 Where a staff member has been directed by the line manager to reduce his/her long service leave balance to 15.6 weeks, the staff member's long service leave balance will be adjusted in accordance with the terms of the direction.

4.4 Where a staff member's long service leave balance exceeds 15.6 weeks (592.8 hours) at either 1 February or 1 August in any year, that staff member shall immediately be deemed to be absent on long service leave and his/her long service leave balance will be adjusted accordingly until the balance is reduced to 15.6 weeks (592.8 hours) without compensation.

5. Long Service Leave on Termination - Trades and Services Staff

In the event of termination of employment, a staff member will not be paid in lieu for accrued long service leave in excess of 15.6 weeks (592.8 hours), except where the termination precedes a date already agreed or directed for the reduction of the staff member's long service leave balance to 15.6 weeks or less.
